3.1 — About Dark Clown

3.2 — Eligibility & Account Information

You must be legally capable of entering into a binding contract under applicable Indian law to place an order. If you are under the age of majority, you may use the website only with the involvement and consent of a parent or legal guardian as permitted by law.

You agree to provide accurate, current and complete information when placing an order and to update it when necessary. You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account, subject to applicable law.

To create an account you must tick the box on the sign-up page confirming that you agree to these Terms & Conditions and our Privacy Policy. We record the date and time of that agreement. You can pause or permanently delete your account at any time (see Section 3.15).

3.3 — Products, Images & Availability

We make reasonable efforts to show product descriptions, sizes, colours and images accurately. Actual colours may vary due to screen settings, lighting, fabric batches or production differences. All products are subject to stock availability.

We may correct genuine listing errors, update descriptions and discontinue products. If an error materially affects an order already placed, we will take reasonable steps to contact you and provide a lawful resolution.

3.4 — Prices, Taxes & Payments

Prices and applicable taxes will be displayed at checkout. Delivery fees, discounts and promotional conditions will be shown before the order is submitted. Prices may change for future orders without changing the agreed price of a confirmed order, except where correction or cancellation is legally justified.

Payments are processed through the payment methods made available at checkout. DARK CLOWN does not ask customers to disclose card PINs, passwords or one-time passwords to staff or delivery agents.

3.5 — Order Acceptance & Cancellation

An order confirmation acknowledges receipt of your order; it does not prevent us from cancelling an order where there is a legitimate reason, such as a stock issue, payment failure, suspected fraud, material listing error or delivery unavailability.

If we cancel a prepaid order, the amount paid for the cancelled order will be refunded in accordance with applicable law. Customer cancellation requests are subject to the order's processing and dispatch status and the cancellation policy published on the website.

3.6 — Returns, Exchanges & Refunds

Returns, exchanges, refunds and cancellations are governed by the Return & Exchange Policy and any product-specific terms shown before purchase. Nothing in these terms limits any consumer right or remedy that cannot lawfully be excluded.

3.7 — Acceptable Use

You must not use the website for unlawful purposes, attempt to interfere with its security or operation, submit malicious code, impersonate another person, misuse payment systems, or infringe the intellectual-property or other rights of DARK CLOWN or any third party.

We may restrict or suspend access where reasonably necessary to protect customers, the website or our business, subject to applicable law.

3.8 — Intellectual Property

Unless stated otherwise, website text, branding, logos, product artwork, photographs, graphics and other content are owned by or licensed to DARK CLOWN and are protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, modify, commercially exploit or use website content or brand assets without prior written permission, except as permitted by law.

3.9 — Third-Party Services & Links

The website may rely on third-party payment gateways, logistics providers, analytics services or external links. Their services may be governed by their own terms and privacy notices. We are not responsible for independent third-party websites, but this does not affect rights you have under applicable law.

3.10 — Privacy & Communications

Personal information submitted during browsing, checkout or customer support will be handled according to our Privacy Policy, the Digital Personal Data Protection Act, 2023 and other applicable Indian law.

By providing contact details for an order, you agree that we may send service-related communications such as order confirmations, shipping updates and support messages. Marketing communications are sent only with your separate, optional consent (see Section 3.16).

3.11 — Disclaimers & Limitation

We aim to keep the website available and information accurate, but uninterrupted access cannot be guaranteed. To the extent permitted by law, we are not responsible for losses caused by events beyond our reasonable control or by misuse of the website.

Nothing in these terms excludes or limits liability, warranties or consumer remedies that cannot be excluded or limited under applicable law. Any limitation applies only to the extent legally permitted.

3.12 — Events Beyond Reasonable Control

We will not be responsible for delay or failure caused by events beyond our reasonable control, such as natural disasters, severe weather, transport disruption, government action, labour disruption, internet or power outages, or courier interruptions. We will take reasonable steps to minimise the impact where practical.

3.13 — Changes to These Terms

We may update these terms by publishing a revised version on the website and changing the effective date. Updates apply prospectively, subject to applicable law and any rights arising from orders already confirmed.

3.14 — Governing Law & Disputes

These terms are governed by the laws of India. Disputes will be subject to the competent courts and consumer dispute-resolution forums having jurisdiction under applicable law. Nothing in this clause removes a consumer's statutory rights or restricts access to a legally available forum.

3.15 — Account Deactivation & Deletion

You can manage your account from My Account → Privacy & Data:

• Deactivate — pauses your account. Your data is kept, marketing emails stop, and you can reactivate at any time by signing in again. While deactivated you can still shop as a guest.
• Delete permanently — erases your profile, saved addresses, wishlist, cart, product reviews (including photos and videos) and newsletter subscription. This cannot be undone. We send a confirmation to your email once it is done.

Deletion is available once all your orders have been delivered, cancelled or refunded and no refund request is open, because we need your contact details to complete them.

Records of past orders, invoices and refunds are not deleted: we are required to keep them under Indian tax and accounting law, as permitted by Section 8(7) of the Digital Personal Data Protection Act, 2023. They are kept only for the period the law requires, used for no other purpose, and are no longer linked to an active account.

3.16 — Marketing Communications & Consent

We send newsletters about new drops, restocks and offers only if you choose to receive them — by ticking the optional box at sign-up, subscribing from the website footer, or turning it on in your account. It is never a condition of creating an account or placing an order, and the box is never pre-ticked.

You can withdraw this consent at any time, as easily as you gave it: use the “Unsubscribe” link in any newsletter, or turn marketing emails off under My Account → Privacy & Data. Deactivating your account also unsubscribes you, and you will not be re-subscribed unless you opt in again. Withdrawing consent does not affect order, delivery or account emails, which are part of the service.
